Motion Brown second Cox to adopt Resolution No. 1982-8 accepting petition for annexation by Amanda Potterfield, John W. Grace and Betty Lou Grace, agreements requiring R-1 zoning to conform to zoning regulations, issues a permit for single family dwelling with agreement to file for R-1 zoning, waiver in event that the state turns down the petition releasing city from all liability, providing for hooking on to water and sewer services as specified. Attorney Sladek stated that the city is putting the carriage before the horse and must have the understanding that petitioners will cooperate and the city will cooperate back. Mary Formanek: What about the extra fees for the city attorney? Attorney Sladek: The attorney on the other side prepares the papers and I review. It will probably take a total of two hours of my time. Roll call vote: Cox, aye; Brown, aye; Spivey, nay; Rohret, nay; Stevens, aye. Carried. Motion Stevens second Cox to authorize issuance of a building permit for tract 2 of the annexation as requested by Amanda Potterfield once the papers are filed and drawing is presented to city clerk. Roll call vote: Cox, aye; Brown, aye; Spivey, nay; Rohret, nay; Stevens, aye. Carried. Greg Downes appeared on behalf of Wear, Wear and Downes requesting that waterworks bills be sent directly to the tenants of the Tiffin Apartments rather than to the owner of the apartments. At the request of Downes, the clerk explained current billing procedures and procedures for discontinuance of service. Spivey: It's come up at other times and I don't think we should change the policy. Mr. Voparil's apartments are also metered separately. Rohret: I see no reason to change. It would set a precedent for everything else. It isn't worth the hassle. Cox: Mr. Voparil will ask next. Downes: Do tenants pay utilities on rented houses? Spivey: Yes. But they are not apartments. Downes: I'm billed the same as eight homes. I don't know why we should be treated any different. I'll guarantee payment of bills if we get delinquency notices. Stevens: I don't like the way some things are done as far as apartments go. Attorney Sladek: May want to change current billing policy. Motion Stevens that tenants of Tiffin Apartments receive separate billing for waterworks systems sent directly to each tenant. Motion failed for lack of a second. Downes requested copies of all ordinances relating to water. Clerk stated that she did not think there was anything in writing regarding billing policy. It has been practice since system was installed.
