Stevens: Only cost is the road and I think it won't be high priority to repair that section of road. Understand it is a low priority area. Mayor Brotherton called for a motion. Motion Rohret to deny the request by Miss Potterfield and John W. Grace for voluntary annexation of three tracts of land north of present city limits on either side of Roberts Ferry Road as presented by petition and drawings by Attorney Joe Johnston. Motion seconded by Spivey. Roll call vote: Cox, nay; Brown, nay; Spivey, aye; Rohret, aye; Stevens, nay. Motion failed. Attorney Sladek stated that procedure to follow is to vote on whether or not to accept resolution to annex property. If resolution passes, clerk and mayor will sign it will be sent to City Development Board in Des Moines for approval. When approval comes back, city will want to rezone tract 2 and dedicate street and approve building permit. Johnston: We will take the chance if you will go ahead and approve and sign the building permit tonight. Engineer Kammerer: Will the petitioner pay the cost of revising the city zoning map? Johnston in agreement. Attorney Sladek: Petition for annexation is separate from zoning. Agreement for rezoning tract 2 to R-1 will be presented with other agreement. Tracts one and three will both come in as A-1 zoning. It is up to the council to waive the normal zoning procedures. If council delays they prefer to stay in the county. It is all being annexed with attorney's agreements and all being done at one time. It is not the best of legal procedures. They have requested it and are willing to live by it. Johnston: It would absurd to annex it if you're not going to rezone it for R-1 at the same time. It is zoned residential in the county now. Mayor Brotherton called for the motion to adopt resolution for annexation. Rohret: Nothing is on paper, yet. Why can't they follow the proper steps like others do? Attorney Sladek: Agreement is contingent upon rezoning. There have not been any notices or hearings. A lot of procedures are being waived. Council is jumping all normal procedures and issuing a building permit based on agreements they will draw up tomorrow. Council adjourned briefly at 9:30 p.m. Reconvened at 9:50 p.m. and tables annexation until Spivey returned. Ralph Bell presented plans for building permit for 220 Summerhays Street. Motion Rohret second Cox to approve request for building permit for single family dwelling 220 Summerhays Street as presented by William Suchomel and to provide water service. Carried unanimously. Sewer service is already into lot. Spivey returned at 9:55 p.m. Bill Verry addressed council on behalf of Bill Rogers requesting water service to the Rogers' property located on the north side of highway no. 6. Verry expressed concern that there's nothing in city maps or files which indicates whether water line has been run to the north side of highway no. 6. Mayor Brotherton recommended tabling request until August meeting in order to check maps and files further.
