Clerk explained insurance policies in relation to liability for operator's of equipment. Mayor Brotherton pointed out that Johnson County Civil Defense owns the truck. By consensus agreement, council formed policy that only city employees will operate city equipment, except in case of emergency such as recent flood where firemen were operating city equipment for the good of the town. City will charge $10.00 per hour for use of equipment at citizen's request, but there will not be any charge if it is something that would be done in the line of duty anyway.
Attorney presented ordinances dealing with moving of buildings and adoption of uniform fire code. Attorney read ordinance for moving of buildings and council directed changes so that engineer's fees will be paid out of bond set by mover.
Attorney read ordinance adopting 1982 edition of the Unifrom Fire Code. Councilmen Rohret introduced ordinance no. 1982-105 AN ORDINANCE ADOPTING THE 1982 EDITION OF THE UNIFORM FIRE CODE. Its adoption was moved by Rohret and seconded by Stevens. Roll call vote: Cox, aye; Brown, aye; Spivey, aye; Rohret, aye; Stevens, aye. Carried unanimously. Rohret moved that the rule or law requiring three readings on three different dates be dispensed with. Roll call vote: Cox, aye; Brown, aye; Spivey, aye; Rohret, aye; Stevens, aye. Carried unanimously. Mayor Brotherton declared Ordinance No. 1982-105 duly passed and adopted.
Motion Rohret second Spivey to set date for public hearing to adopt new City Code for Wednesday, August 11, 1982 at 7:00 p.m. at the Tiffin Methodist Church. Carried unanimously.
Attorney Joe Johnston presented annexation petition and drawing of plat on behalf of Amanda Potterfield and John W. Grace. Johnston stated that Grace's parcels of land are petitioning for annexation strictly for the purpose of providing a 200 foot tract of land which adjoins the city. Grace would not object to A-1 zoning of his tracts. Tract 2 is owned by Amanda Potterfield and she would request R-1 zoning. Annexation would bring in $400-$500.00 in taxes each year. Potterfield would be able to hook onto city services of water and sewer.
Engineer gave opinion that city should consider three things before annexing. The 1979 water and sewer report remain unchanged. Water system is already at capacity but one more house would not cause a significant difference in pressure. But council should consider precedent because city has considerable amount of ground already within limits which is not provided services. Sewer system, with the exception of infiltration/inflow, does not have problems. Should make agreement that not everyone could propose the use of a cheap grinder pump to dump into the system, Could be setting a precedent, but in this case it is different because it is over the top of the hill. Any large addition would require a lift station or a route around the hill. City would take in another one-half mile of streets. Roberts Ferry Road is not in the best condition now. City would have maintenance responsibility.
Attorney Sladek stated that he had not received anything in writing. Agreement would be ready tomorrow if adopt annexation tonight and could make annexation subject to receipt of agreements from Johnston. Street will be dedicated to city after it is annexed. Sewer and water will always be private and owner will maintain. Owners should waive right to object to special assessments to pay for services and cost of hookups if city ever runs services past tracts.
