Jim Neuzil asked the council if he needed permit for the deck he recently built and felt that he had been singled out since other people in town had built decks without a permit. Stapes said that the people did not understand that permit was needed for a deck and he heard after he built one that it had been discussed at a council meeting. Attorney Hoefer stated that at the time Stapes and the other people built their decks there was some confusion among the councilmembers as to whether a building permit was needed for a deck and since they had not understood it at the time they decided to not pursue those that were already built but to require a permit from that time forward. Attorney read part of ordinance which requires a building permit for alterations or extensions to buildings. Stapes asked if a permit was needed if the deck was not attached to the house because his is a cement slab which is not attached to his house. The attorney stated that it would be considered a new structure. Cox stated that is contains no lumber. Attorney stated that a flat cement slab without railings would not be a structure. Engineer Kammerer commented that this is the way most cities interpret a structure. Brown asked if a deck needed a permit if a railing was put around it. Attorney read part of ordinance defining structures. Attorney stated that he could still apply for a permit eventhough the deck had been built. Neuzil expressed concern with being singled out. Attorney pointed out that he was not singled out but was the first person to build a deck after the council had established the policy. Hoyt asked about storage sheds that were not on permanent foundations, and said that many people in the trailer court have storage sheds. Attorney stated that the trailer court is already restricted by a separate ordinance but that it was a good point and she would check on whether people in the court needed a building permit for storage sheds. Neuzil presented sketch for his deck.
