Gish: That would be acceptable, but we would like to have more, in addition to forgiving liquidated damaged. Cox: That bid price was for job done. The engineer could have told us it might be another $10,000.00. We were not told. We've had four engineers on this project. Morgan: Hired them to represent us. Now we're expected to absorb this cost. Baker: We've already spent a lot of time on this misunderstanding. It was your understanding that for $72,000.00 you would get the tower. Work was late. If you forgive the 43 days you have not paid any more money, but you didn't have the use of the tower. There are some costs to citizens in fire insurance. But you're still getting the tower for $72,000.00. Gish: The condition is better than when you bid it. Cox: Do you use this epoxy often? Gish: Weld for structural pitting. Use this epoxy often. Baker: Couldn't use epoxy when it was too hot because it cures too fast. Gish: Could have put in new riser for cost of repair if we had known it would cost so much. Baker: Welding takes too much time. Epoxy is faster and it was the foreman's opinion. Spivey: Are most repairs with epoxy? Gish: Used often. Spivey: Then you ought to be quite familiar with it. Stevens: We were looking to have it done for $72,000.00. We're out the time. If we would have paid them $10,000.00 for repair and they paid us since the time it originally should have been completed, that would have been over 100 days. The next lowest bid was $95,000.00. We saved $20,000.00 by going with them, but had to wait 100 days. Cox: I agree with Greg. The tower is up and completed. Don't feel it was the contractor's fault. Spivey: Does anyone wish to make a motion? Stevens: If we knew then what we know now, we should be satisfied for $72,000.00.
