Text read by the vision model; check the PDF for anything that matters.Spivey: If time not run over, money still been the same.
Stevens: Basically, they would have charged $10,000.00 and we would have charged $10,000.00.
Spivey: The first agreement was for $3,400.00 for repair.
Stevens: $72,000.00 plus pits.
Spivey: Does anyone wish to make a motion?
Baker: The work left is grading, fencing and electrical.
Gish: Electrical work should be finished this week. We're being portrayed as the bad guys. We did everything we could to get along and be open and fair. You have the wrong impression of us. If the tank repair had been in the original price, we would have bid higher. The $3,400.00 figure was not based on complete coverage of inside of riser. Shive-Hattery felt it should be completely covered. They made us change products and use a different kind of sealer. We realize we got a late start, but you're not giving any consideration to the weather. The foundation took 2 1/2 months and spent one month in the motel.
Spivey: You could have had it done if you had started when you should have.
Baker: Electrical work will be done this week. Site work and fencing are left. Arrange to have it all completed during next week.
Gish: I think I'll get it finished next week.
Spivey: What does the attorney think?
Attorney: If it is done in a week, your claim is $5,000.00 and his costs are $10,000.00. I don't know the status of the contract as far as his ability to come in and recover costs at a later time. Can't tell where it might lead in the long run with litigation. That can be very expensive and drawn out.
Gish: We don't want that either. Feel we've done everything we can.
Spivey: No one thinks you're trying to rip us off.
Stevens: No one is losing money. We just lost 100 days. One hundred days doesn't mean that much to me. He's willing to settle for the $72,000.00 and that was our original price. At first it looked like we'd lose money, but now we won't. Engineer was there daily to see that work was getting done right. No sense in putting time on now. Can't control the drying of paint.
Baker: Have arranged with Ralph to test tower.
