Once painting was completed, the agreement was not to charge for curing time and disinfecting. The change order no. 2 was written with the idea that all other work would be done at that time. Through yesterday, 43 days have passed since August 28th.
Gish: Of that time, it took three weeks to apply epoxy.
Baker: Standard specifications that if contractor is late, it is his liability for liquidated damages and extra engineering costs. It costs quite a bit extra in engineering, but not planning to require extra payment. We felt we wanted to keep project on target and keep things moving, not pass our costs to the city or the contractor. If city wants to make some yield in liquidated damage assessed to Service Enterprise Corp. they would appreciate it.
Gish: We wouldn't want to be penalized for the three weeks for epoxy work while we did it for no charge.
Spivey: Did you work on the outside while your were waiting for the epoxy?
Gish: Yes.
Spivey: What are you asking for? The Council needs to make a decision.
Gish: Spent an extra $10,000.00 not in the contract. Repair was not covered in the contract.
Baker: That was settled with change order no. 2. Time and cost was more than anticipated.
Gish: Estimated at $3,000.00. Much more extensive.
Spivey: I voted against that and it came out like I expected. You should have paid us and we paid you. It's the council's decision now.
Cox: The $10,000.00 extra work was not in the specifications. We didn't know that at the time of the bid.
Spivey: Agreement was made later.
Gish: Based on $3,000.00 estimate.
Baker: Repair was agreed upon, but it was more than they thought. You have a quality tower and a good job and a good price, too. There are 43 days of liquidated damages on change order no. 2. Service Enterprise Corp. has $4,300.00 liquidated damages and $10,000.00 extra cost for work already done. Council could forgive some or all of it.
