Attorney Greenleaf: The council has the final say in zoning issues. Only pertinent issues may go to the Board of Adjustment. Bartels: So the P&Z is sort of a buffer to sound it all out? Clerk: Tiffin has to follow the process set forth in the State Code, like everyone else. The P&Z Commission and the Board of Adjustment are both required by law. The whole zoning process is very specific in the Code. AN ORDINANCE AMENDING THE ZONING ORDINANCE NO. 1979-83 OF THE MUNICIPAL CODE OF TIFFIN, IOWA BY CHANGING THE USE REGULATIONS OF CERTAIN PROPERTY FROM R-1 (SINGLE-FAMILY RESIDENTIAL) TO R-3 (MULTI-FAMILY RESIDENTIAL) was introduced by Stoner and read by the City Clerk. It's adoption was moved by Stoner and seconded by Slaymaker. Roll call vote: Stoner, aye; Slaymaker, aye; Morgan, aye; Brown, aye; Bartels, aye. Carried unanimously. Brown then moved and Bartels seconded that the rule or law requiring three readings of this ordinance be dispensed with. Roll call vote: Stoner, aye; Slaymaker, aye; Morgan, aye; Brown, aye; Bartels, aye. Carried unanimously. Stoner then moved and Brown seconded for final adoption of this ordinance. Roll call vote: Stoner, aye; Slaymaker, aye; Morgan, aye; Brown, aye; Bartels, aye. Carried unanimously. Mayor Potter declared Ordinance No. 1990-169 duly passed and adopted. Council set date of public hearing for CDBG application as Wednesday, October 10 at 6:30 p.m. at the fire station. Potter recommended and council consensus to continue with part-time grounds maintenance help for another month. Greg Stevens reported that when he took his application for a Class "C" liquor license to the Alcoholic Beverage Division, he was told he needed to apply for a beer garden permit to operate the outside volleyball court and serve in the way he has been doing. He could apply for a one-day permit, a one month permit, a six month permit or for a whole year. He asked to apply for a yearly permit so that anyone outside would be covered. Stevens stated that he did not plan to wait on people outside and he would pick up debris left outside. Potter asked if he could do a street dance anytime then. Stevens stated that he would continue to do only one dance per year and would get permission from the council. Motion Brown second Bartels to approve request by Greg Stevens and Terry Miller of Slim's Saloon for a beer garden permit for a period of one-year. Roll call vote: Stoner, aye; Slaymaker, aye; Morgan, aye; Brown, aye; Bartels, aye. Carried unanimously. Discussion of need for back-up operator on sewer plant. Morgan: We should make Bob take the certification test. I think we have a list of concerns. Potter: Ralph did everything. He plowed the streets. We've upgraded the equipment and we have a new building. The job should be easier. We're paying two part-time people with the mowing and the testing. Things are falling behind. I'm tired of hearing townspeople talk to me about this and asking why we're paying part-time help. Morgan: We need a discussion with Bob. Slaymaker: How much city grass it there?
