Mayor Potter called meeting to order at 7:10 p.m. Members present were Stoner, Slaymaker, Morgan, Brown and Bartels. Also were Engineer Mike Hart, Attorney Stephen Greenleaf, Kathy Kees, Alverta Williams, John Schneider, Attorney David Brown Tom Morgan and D.R. Miller.
During community forum Morgan reported an abandoned jeep on the north side of town. Potter stated that he would take care of calling the Sheriff's Department.
Motion Morgan second Brown to approve agenda. Carried unanimously.
Motion Brown second Slaymaker to approve minutes of August 8, 1990. Carried unanimously.
Attorney Greenleaf: I reviewed the conflict of interest laws briefly and I do not believe there was any disqualifying interest in the action by the P&Z Commission in regard to Mrs. Williams and the request by John Schneider. It was a legitimate meeting and a legitimate vote.
Stoner: I've seen John's commitment to quality. I think it would appreciate the properties surrounding it. The gas station should be commercial, too.
P. Brown: The council should think about rezoning other lots in town. I'm tired of appointing members to these committees and then having them quit. The town is too small for all of this.
Morgan: I agree with Pam. If the Hardware Store burns down, it can't go back up without being rezoned. This could be an abandoned town someday. If we close the station we can't put in a HandiMart.
P. Brown: It was a big mistake to zone that whole block R-1.
Potter: The P&Z Commission was formed at that time. They were not supposed to spot zone here and there. They decided every business would always be that way and go back to residential after it quit being a business. This way, the council has control. The paint store is an example. It has reverted to residential. I think the council did a good job at that time. They stopped some problems before they got started.
Bartels: People work hard on these committees and make recommendations and then the council comes in and overturns them.
Potter: The council has only done that once before.
Bartels: It's hard to get people to serve on these committees.
P. Brown: If a businessman is on the P&Z, it could hurt his business.
Potter: People couldn't foresee everything 15 years ago.
Williams: What's the use of the P&Z if it's going to be overturned? They are supposed to carry out what is set out before them.
