The Developer may not grade orotherwise disturb theearth, remove trees, construct sanitary sewer mains, storm sewer mains, water mains, streets, utilities, public or private improvements oranybuildings until thefollowing conditions have been satisfied: 1. This Agreement hasbeen fully executed byboth parties, filed with the City Clerk, and approved bytheCity Council; 2. The Developer has complied with theerosion control and grading provisions setforth inSection 5ofthisagreement; and 3. Allpermits required bylocal, state, andfederal lawhave been applied for andissued bytheappropriate authority. 4. Contingent upon thepermitting requirements setforth inParagraph 3of this section being met, allnecessary construction permits have been applied for and issued bytheCity. SECTION 3.DEVELOPMENT REQUIREMENTS AND PUBLIC IMPROVEMENTS A. Development Standards. The subdivision shall bedeveloped according tothe preliminary subdivision plat asapproved by theCity and according tothe plans and specifications asapproved bytheCity. Allconstruction plans shall beapproved before the commencement ofanywork inaccordance with thesubdivision plat. There shall benovariance from thepreliminary plat, orfrom theconstruction plans and specifications, unless approved in writing bytheCity. B. Public Improvement Standards. Allimprovements and facilities described inthis Agreement shall beconstructed and installed bythe Developer according tothe plans, specifications, ordinances andstandards ofthe City andinaccordance with allapplicable federal andstate laws andregulations. Allrequired inspections shall beperformed bytheCity Engineer ordesignate. Said inspections shall consist ofinspection ofthework inprogress butshall not relieve orrelease the Developer from itsresponsibility toconstruct said improvements and facilities pursuant totheagreed upon plans andspecifications. These improvements andfacilities include butarenot limited topublic water system; sanitary sewer system; storm sewer and drainageway system; sitegrading; underground utilities; setting forlotand block monuments; andsurveying andstaking. C. Standard Requirements. Further, theDeveloper agrees that: 1. Allstreets shown ontheplatwill beconstructed ofconcrete paving with concrete curb andgutter, which willbeshown ontheconstruction plans, tobeapproved bytheCity Engineer, andwillbededicated totheCity. 2. The Developer shall provide fortheinstallation ofallelectric lines, street lights, gasmains, telephone lines and other utility facilities that arenecessary atthe underground. 2
