Aspart ofthis request, Developer acknowledges Patrick Hammes, PegRogers and Kaiser Holdings, LLC therealestate described onExhibit B. SECTION 2.CONDITIONS OFPLAT APPROVAL AND RIGHT TOPROCEED A. The City shall approve thepreliminary plat ofthis subdivision upon the conditions that: 1. The final plat(s)willconform tothepreliminary plat; 2. The construction plans willbesubmitted andapproved; 3. The public improvements will beconstructed inaccordance with approved construction plans and accepted bytheCity or,inthe event theDeveloper requests and theCity agrees totheconstruction ofthepublic improvements after final platapproval, theDeveloper hascomplied with thesecurity requirements set forth in Section 5.12oftheTiffin Subdivision Ordinance andSection 7ofthisAgreement; and 4. The Developer enters into andabides bythisAgreement. B. The Developer further agrees that this Agreement shall beacovenant running with thelandandshall bebinding onthepresent andfuture owners oftheproperty.
