Attorney Hoefer reported that City won the case in magistrate's court concerning mobile home at 210 Summerhays Street and that Gaylord Augustine was fined $50.00 because he was found to be in violation of the City's Zoning Ordinance at the time of summons. Augustine has since removed mobile home from the property. Attorney reported that Augustine will appeal the decision and trail date has been set for July 31st in district court. Attorney Hoefer recommended dismissal of case since Augustine has removed trailer and because costs incurred in processing case would probably be greater than the $50.00 fine. Mayor suggested, and Council agreed, that the Council should take Attorney's recommendation under advisement and will make a decision at the special meeting scheduled for July 22, 1981.
