Potter reported that Louis Voparil of Grandpa's Gas and Grocery turned his own water on and does not have a meter because the fittings were in crooked. Tap on fee and meter are not paid for. Clerk sent statement after learning that water was turned on. Attorney stated that Voparil had no right to turn water on himself. City could turn it off until fees are paid. Potter stated that he would handle it.
Motion Rohret second Potter to place item M concerning Dave White under item 7 police report. Carried unanimously.
Jerry Madden addressed Council. He stated that he would like to move trailer off of lot at 101 Summerhays St. and put another trailer in there. He stated that he owns the trailer and is buying the lot. Attorney Sladek advised Council that according to Zoning Ordinance No. 1979-83, when a non-conforming use stops being used for the purpose which makes it non-conforming, the property reverts back to the zoning. Property only continues to be non-conforming usage as long as it is continuously used for that purpose or for a lower usage. There are no restrictions on property transfer. Lot in question is zoned R-1 (single-family residential). Madden stated that he moved out of trailer over one year ago because it was not in his name. The trailer is not safe to live in. He waited this long to do something until it was in his name. Potter stated that the sewer line runs under the trailer and that a house could not be built on that lot. Formanek stated that Madden could go to the Board of Adjustment and ask for a variance to zoning ordinance in order to put trailer on lot. Board of Adjustment could grant variance if it feels it is in the best interest of the public. Attorney advised that Board of Adjustment would have to meet first and elect a chairman. Madden could request the chairman to call a meeting of the Board of Adjustment to make a decision on request.
