Motion Potter second Rohret to approve minutes of November 11, 1981 and special meeting November 24, 1981. Carried unanimously.
Ray Scheetz addressed the council concerning the dike on city property. He stated that he has raised the ground around the manhole, rocked the road going over the dike, will get rid of brush and trees and that the low spot was already there before he began work. He also stated that the dike is an asset to the town and that he has cleaned up and developed an area that otherwise would not have been developed. The property appraisal by Williams Realty shows a value of $1,500.00 for the 0.80 acre of land and does not take anything else into consideration.
Motion Potter second Spivey to direct city attorney to draw up a resolution to sell the property contained in the legal description presented to the council to Ray Scheetz for the amount of $2,000.00 and in addition Mr. Scheetz will pay up to but no more than $500.00 in incurred legal and closing costs pertaining to the development of abstract and title to property and will raise the manhole, remove the brush pile, and will also grant to the City of Tiffin a permanent easement across said property as is necessary for the city to enter into city property. Roll call vote: Madden, aye; Potter, aye; Spivey, aye; Rohret, aye; Williams, aye. Carried unanimously.
John Schneider addressed council concerning paving of parking lot and driveway at Ice Cream Store. He stated that he has retained a contractor and made a partial payment for pavement and that area will be paved before June 1, 1982. He plans to open business in April.
Motion Potter to amend proposed agreement with Schneider Apartments to allow them until June 1, 1982 to pave driveway and parking area of Ice Cream Store and to strike from the proposal the part about not opening business until lot is paved.
Council decided that it was not necessary to enter into an agreement under these modified terms. Schneider restated that he will pave the driveway and parking lot by June 1, 1982 and will also take care of dust problem by using oil or the Council may do whatever they wish. Formanek pointed out that Schneider is already legally obliged to pave area.
Potter withdrew his motion.
It was the consensus of the Council to allow Schneider Apartments to open the Ice Cream Store in the spring with the verbal promise from John Schneider that the driveway and parking lot would be paved by June 1, 1982 or council may bring legal action against him.
