Minutes-07/14/1982

A special meeting called by Joe Johnston, July 14, 1982 called to order at 7:35 p.m. by Mayor Pro Tem Jerry Cox, for the purpose of presenting petition for voluntary annexation by Amanda Potterfield and John W. Grace. Roll call: members present Chuck Rohret, Ted Spivey, Denny Brown, Jerry Cox. Also present Attorney Sladek, Amanda Potterfield and her attorney Joe Johnston. Absent were Greg Stevens and Mayor Brotherton. Copies of petition passed out to council members. Attorney Johnston said the Code of Iowa states that in order for a piece of land to be annexed into city thay it must be connected by a minimum of 200 feet tract of land. For that reason, Bill Grace has offered a strip of 200 feet wide bordering on A.J. Session's (Clyde Wolfe) property. Amanda would pay cost of water and sewer. Reason for wanting to be in city and not in county is because of the cost of sewer and well and because of footage requirements to build on the property. Lift station would be privately owned. If Bill Grace were later annexed in, Potterfield's lift station would be done away with. Public voiced opinions. Attorney Sladek recommends we talk to our engineer about water, streets and zoning. If do vote "yes", make up agreements ahead of time with Miss Potterfield. Attorney Sladek did make comment on "L" shape property (tract 3) that if it is annexed, then it would be open for building. Recommends we have our engineer take a look and only vote after engineer has seen plans. Council decided to wait until discussion with engineer. Asked Attorney Johnston if he wanted on agenda for Monday, July 19, 1982 meeting or to withdraw petition. Agreed to go on for Monday unless he contacts Attorney Sladek before Thursday.
