Text read by the vision model; check the PDF for anything that matters.DeWitt: It is stated clearly in the specifications that the council can adjust the quantities as appropriate as far as bids will allow within the budget. Could delete alley.
Potter: We should accept them as sent out.
DeWitt: The base bid has to be accepted. Can adjust within that. Can walk through and mark areas to be done and measure accurately.
Potter called for the motion to accept the low bid from Pelling.
Spivey asked about doing Roberts Ferry Road.
DeWitt stated that if the alley was taken out of the project, it would cost about $1,500.00 more to do the hill.
Potter called for the motion to accept the low bid.
Motion Kobold to accept base bid of $6,105.00 at $1.20 per square yard from L.L. Pelling for 1984 street repair program. No second. Mayor declared motion dead for lack of a second.
Beverly Birtcher asked council for permit to place 16 x 70 foot manufactured home on lot at 312 Grant Street. She stated that she plans to convert it to real property under the Code of Iowa and that water, sewer and gas are already run into the lot. She passed pictures of the manufactured home and the garage as well as a drawing of the location of the home.
Spivey asked if the attorney had researched the new law dealing with manufactured homes.
Attorney: State amended chapter 414 of Code providing that city shall not adopt or enforce zoning or other ordinances which disallow dwelling solely due to it being a manufactured home. Manufactured homes must be located and installed under same standards which apply to site built single-family dwellings. Amendment also defines manufactured home. A mobile home is not a manufactured home unless it is converted to real property and taxed as such. A review of your zoning ordinance shows that set backs are provided in R-1. There is no provision specifically excluding manufactured homes. Have not talked with Iowa City or other larger communities although have declared moratoriums until they decide how to respond. Your ordinance does not say that all trailers have to be in trailer court.
Spivey: Will this home have a continuous foundation or piers or posts?
Attorney: Foundation system is not addressed in ordinance.
Spivey: What does the new law say about foundations?
Attorney: It shall require same standards as site built homes, including but not limited to foundation system. There would be a problem excluding a building due to type of foundation. Must apply zoning standards to manufactured homes. They could change the character of the zoning district. Legislature felt there was discrimination in the past against manufactured homes.
Potter asked if this needed to be resolved before August 8.
