Cox introduced AN ORDINANCE REGULATING DANGEROUS AND VICIOUS ANIMALS WITHIN THE CITY OF TIFFIN, IOWA. Attorney summarized ordinance and it was duly considered and previously read by council. Its adoption was moved by Cox and seconded by Morgan. Roll call vote: Cox, aye; Morgan, aye; Kobold, aye; Stevens, aye; Spivey, aye. Whereupon the Mayor Pro-tem declared the motion carried. Councilman Stevens then moved that the rule or law requiring three readings of this ordinance on three different dates be dispensed with. On roll call Council Cox, aye; Morgan, aye; Kobold, aye; Stevens, aye; Spivey, aye. Mayor Pro-tem declared Ordinance No. 1984-125 duly passed and adopted.
Discussion of who should pay for repair of water line at fire station. Cost is $400.00 for labor and digging in new line and $128.09 for materials. Council directed to send copy of statement to Tom Morgan and Dennis Brown for input from the Fire Department and Fire Association, and to place on next month's agenda.
Attorney reported that Tim Spivey met with Board of Adjustment October 9th. Tim withdrew his original request and since his current request had not been to the Council, the Board could not act.
Tim Spivey requested permission to place 24' x 60' manufactured home on lot at 105 College Street and to move small trailer to back of lot. If this is not possible, his second request is to place 24' x 60' manufactured home on south side of lot at 105 College Street, leave the small trailer where it is, and redraw lot lines to accommodate the new home. Tim stated that no one lives in small trailer. He uses it as a workshop. He could get rid of it, but prefers not to. Attorney stated that Iowa Code defines trailer court as any parcel of land containing two or more trailers. Attorney also stated that moving the small trailer to the back of the lot would violate the Zoning Ordinance No. 100 which excludes trailers from R-1 zones, and redrawing lot lines to less than 90' x 140' violates the Zoning Ordinance No. 83 concerning lot size. Attorney advised Council that both requests were in violation of ordinance.
