called attorney's office who drew up papers to serve on Mr. Voperil to cease construction because he is in violation of ordinance. Papers were served and Mayor reported he had not heard from Voperil since. Attorney said Voperil has filed complaint against town and a trial date will be set by court tomorrow. Attorney asked council what would be acceptable penalty for court to impose if Voperil is found guilty of violating city ordinance. Consensus of council to ask for fine of $100 dollars and court costs. Motion Stoner second Eggers to send certified letter to Louis Voperil to clean up trash and debris on property at 230 Main St. Carried unanimously. RESOLUTION FOR A PUBLIC HEARING FOR THE GRANTING OF AN EASEMENT TO VANTAGE CABLE OVER THE FOLLOWING PROPERTY (vacated alley bounded by Railroad and Second and Grant and College Streets) was introduced by Eggers seconded by Morgan with hearing date set for Wednesday, September 13, 1989 at 6:45 p.m. at the fire station. Roll call vote: Eggers, ave; Morgan, ave; Stoner, ave; Stratton, ave. Mayor declared Resolution No. 1989-7 adopted. Mayor reported phone conversation with Vantage in which he told Vantage of citizen complaints of double-billing. Mayor also told company that green box is still in the ditch and that town has no maps of where cable is run. Mayor said Vantage employee told him that green box in ditch is Rugger's problem. Hart reported that he talked to Vantage and that they would send location maps. Morgan reported that she received a call from Louis Voperil who said the water meter was broken at Grandma's Grocery Store. Bob Herring was on vacation. Morgan called Mike Hart who called a company who would come out and fix it. Company needed to know location of meter but Morgan said Voperil informed her he was too busy to deal with it that same day and company would have to come the next day. Company returned the next day and replaced the meter. Morgan wanted clarification on whose responsibility it is to maintain the water meters. Clerk said ordinance passed in 1980 puts cost of digging into water line, cost of new meter and maintenance of water meter onto customer but city had continued to repair and replace meters at no charge to the customer. Hart said maintenance refers to any damage or misuse of the meter by the customer. He said if meter goes bad cities usually pay cost for repair or replacement. Council instructed attorney to draw up amendment to ordinance which takes repair and maintenance responsibility away from the customer and back to the city. Motion Morgan second Stoner to approve request by Greg Stevens and Terry Miller for renewal of Class "C" liquor
