Minutes of Regular Council Meeting, Tiffin, Iowa, April 3, 1968 The regular council meeting was called to order by Bill Bream, Mayor Pro Tem. Glen Potter, Ted Spivey, Fred Moore, and Ned Allen answered to the roll call. Also present were Ralph Neuzil, Mr. Findlay, John Carter and Mr. Hutchins, and the Mayor, James O'Toole. The minutes of the last meeting were read and corrected to change the reference to the test boring to pertain to the well site rather than the school site. Bill moved, Glen seconded the motion for this correction. All in favor. OLD BUSINESS Water: Mr. Neuzil stated that he spent about three hours with Mr. Tomatich, and has a great many forms which must be filled out. The town must acquire legal title to the water tower site. Mr. Neuzil obtained the legal description of the site from the engineer and gave it to Bill Tucker, the legal counsel for the school board. The school board was to meet in special session yesterday or today. Mr. Tucker is of the opinion that we will have to go through the procedure of showing that it isn't need for school purposes--posting, advertisement, etc. He is working on that with the school board, and they meet again on the 18th of this month. The engineer told Mr. Neuzil that they have the plans almost completed. Two easement problems remain to be worked out: (1) Oscar Bigelow easement, which is a matter of getting the papers drawn as legal description on it, and (2) Clements for an easement on the north side of the sewer rather than on the south side. Ted reported that he had no luck talking with Mr. Clements. The engineer states that the change in easement is necessary because the State Department of Health will not let them get closer than ten feet to a sewer pipe with a water pipe, and he says that he will not permit someone to dig these lines right on the ten-foot mark. We are at a stand-off until Mr. White can get these people to give a definite "yes" or "no." The Mayor talked to Mr. Reed about going south on the railroad property. Gas Franchise: The Mayor, James O'Toole, presided at this meeting and the Town Clerk, Margie O'Toole, acted as Clerk of the meeting. The Mayor stated that Iowa-Illinois Gas and Electric Company, an Illinois corporation, had submitted a proposed gas franchise to be granted by the Town of Tiffin, Iowa, to said Iowa-Illinois Gas and Electric Company. He then presented a proposed ordinance granting a franchise to said Iowa-Illinois Gas and Electric Company, which ordinance was fully and distinctly read; it is entitled: "AN ORDINANCE GRANTING TO IOWA-ILLINOIS GAS AND ELECTRIC COMPANY AND TO ITS SUCCESSORS AND ASSIGNS FOR A PERIOD OF TWENTY-FIVE YEARS THE RIGHT AND FRANCHISE TO ACQUIRE, ERECT, MAINTAIN AND OPERATE IN THE TOWN OF TIFFIN, JOHNSON COUNTY, IOWA, A GAS PLANT OR PLANTS FOR THE PRODUCTION, STORAGE, TRANSMISSION, DISTRIBUTION, SALE, DELIVERY OR FURNISHING OF GAS FOR PUBLIC AND PRIVATE USE IN THE TOWN OF TIFFIN AND ELSEWHERE AND TO USE THE STREETS, AVENUES, ALLEYS AND PUBLIC GROUNDS AND BRIDGES IN THE TOWN OF TIFFIN FOR THE PURPOSE OF LAYING, CONSTRUCTING, MAINTAINING, REPLACING AND SUBSTITUTING MAINS, PIPES, CONDUITS AND OTHER FACILITIES FOR THE TRANSMISSION, DISTRIBUTION, SALE, DELIVERY OR FURNISHING OF GAS FOR PUBLIC AND PRIVATE USE IN THE TOWN OF TIFFIN AND ELSEWHERE." Councilman Glenn Potter then moved that the aforesaid constituted the second reading of this ordinance. The motion was seconded by Councilman Bream. A roll being called on said motion, the following councilmen voted "Aye": Potter, Moore, Allen, Bream, Spivey. After discussion, the Mayor announced that the council will hold its next meeting for consideration of the third reading of this ordinance on May 2, 1968, at 7:30 o'clock P.M. at the council chambers.
