Present: Bill, Fred, Ted, Glenn, Ned, Ralph Absent: None
Minutes of the last meeting were read and corrected to read "75-year lease... (check)"
OLD BUSINESS:
Water: Ralph reported on easements. The material which has to be done by the FHA on easements was held up by Tomatich. As soon as I got it, I had to endorse it, put in the changes they want: "basically, that it is agreed that the town should have the right to Cancel or [blank] the lease if the school sells the property while this lease is in effect they should in order to have the FHA, etc. ralph sent it back to FHA on June 26; they sent it back approved the enclosed lease between Clear Creek District and the Town of Tiffin has been corrected by our attorney and is sufficient. He will immediately notify the school district of our intent to option and will immediately proceed to buy the property and will notify Powers. It looks like our easements will cause cost us according to the people, $1.00 a foot. I asked Powers & Assoc. and they said it's high, but it's not unreasonable to go through condemnation.. Bigelow told them there would be no way we could give them $500 and told them we would have to start condemnation proceedings just a matter of law. I know the maximum that could be allowed was $1.00 a foot. Where is the money coming from to pay them if the FHA will allow us to do this.
Stipulation on agreement that (1) It is subject to the approval of the FHA.
Talked with Mr. Woolf once more. Would rather sell for that purpose. Talked to the engineer Wayne Reed and he expressed his views, went over the same reasoning I had given to Ken Herdliska. I did not write Ken any letter: (1) wasn't authorized to, and (2) I don't like to put anything in writing. Bill Bream
Resolution: (wording to be furnished by Mr. Neuzil) Call him
Read by Mr. Neuzil. to #12 "to hold Clear Creek School District free therefrom." The description of agreement has been read between the Town of Tiffin and the Clear Creek School District. The conditions of the agreement were discussed by the Council and agreed upon with the necessary correction in Paragraph 12 and the council is of a vote by a show of hands that this resolution be accepted--unanimous. We therefore resolve that this agreement has to be.... Bill introduced the resolution, Ted seconded, all in favor.
Railroad Closing Petitions: It was suggested that DeWaine be asked to pick up completed petitions in the Oxford area and that all of them be sent to the Board of Supervisors with a cover letter.
Ingham Road Extension: Mr. N. read letter he wrote to Mr. Ingham on June 12. No answer. It would appear that the first thing we would have to do is get Powers here to give us a legal description on it. After that, start our notice of condemnations. Wayne Reed arrived at the Council meeting this evening and was informed of this request. Removal of sign from right of way was discussed. Mr. Neuzil will write.
Ralph saw the Chairman of the Board of Supervisors about the shanty on county property and they agreed that they shouldn't have one out there. They were informed that it had been used only for storage space for a year and a half.
Water Tower: Wayne won't know until bids are taken. Will take bids on both water tower being disassembled and moved and a new standpipe. The standpipe may be more economical but there will still be the question of whether / FHA will back you on the extra amount of money for the elevated tank..
Borings taken last week, and no report yet.
Check ordinance on sewer bills unpaid for 90 days.
