Amendment: Section5.13 U(ix)(a)REQUIREMENT OFTHE FINAL PLAT ofthe Tiffin Subdivision Ordinance ishereby amended asfollows: ix.S a. Anagreement executed bythe subdivider which agrees, asacovenant running with theland, that theCity shall notissue abuilding permit forany lotinthe subdivision until thesubdivider installs thepublic improvements, except sidewalks, according toplans and specifications approved bytheCity Engineer and until theCity Engineer approves subdivision erosion control measures. Ifthesubdivider desires a building permit prior toinstalling theimprovements, theowner must deposit with the City Finance Department anescrow equal tothecost ofimprovements plus 10percent thereof incash lotsinthesubdivision and collected onaperlotbasis prior totheissuance ofabuilding permit. Subdivider must further agree, asacovenant running with the land, that subdivider will install sidewalks abutting each lotinthesubdivision assetforth inthis Title, that theobligation toinstall thesidewalks remains alien onthe lots abutting the sidewalk until released bytheCity and that, intheevent subdivider fails toinstall the sidewalk theCity may install thesidewalks andassess thetotal cost against theproperty without meeting therequirements ofnotice, benefit orvalue required byState lawfor assessing improvements. Section V. Amendment: Section5.14 REVIEW; APPROVAL OR DISAPPROVAL ofthe Tiffin Subdivision Ordinance ishereby amended asfollows: 5.14 REVIEW; APPROVAL ORDISAPPROVAL A) Upon the filing ofthe final plat assetforth above, theCity Clerk shallsubmit 11 copies ofthefinalplat andtheapplication totheappropriate City Departments forreview asdesignated bythe CityAdministrator; B) Said designee(s)shall examine theapplication, theplat, theconstruction plans, andthe legal documents toinsure compliance with therequirements oftheCityCode, State law, andthepreliminary plat. C) The costs oftheengineering examination ofthefinal plat, construction plans, and anyother engineering administration costs andfees incurred inconjunction with thefinal plat, shall bepaid bythesubdivider andshall bethe actual costs ofthe engineering examination and review asincurred bytheCity.
