Attorney Hoefer advised Council that any city with zoning must establish a Board of Adjustment as required by State Code of Iowa. Board of Adjustment and its powers must be part of zoning ordinance. Potter will find people to serve on Board. Board of Adjustment has final authority to grant a variance. If Board denies variance and Council favors it, Council must amend ordinance. Council cannot grant variance. If Board approves variance and Council does not favor it, Council could deny building permit for other valid reason. Person asking for variance goes directly to Board of Adjustment.
