Brown: The difference is that lot no. 5 has three single family houses on south side of it. Lot no. 3 does not adjoin any single-family dwellings.
Mayor Brotherton: If lot no. 3 already R-3, what would be your opinion toward rezoning lot no. 5? What we do in lot no. 5 will reflect on lot no. 3.
Spivey: There are too many people in a small space.
Mayor Brotherton: Could act as buffer zone.
Stevens: Is there enough water and sewer for lot 3 to be rezoned R-3 also?
Kammerer: There is definitely enough sewer capacity. Water system is at capacity. Adding more people would decrease pressure. Rezoning only these two lots would not adversely affect water system.
McDermott: Consider rezoning request as separate from request for building permit. Would also have to apply for building permit. This is a land use question.
Stevens: What about an R-2 use?
McDermott: This is a request for R-3. The building might not be an 8-plex. Mr. Voparil has not gone to the expense of drawing up plans, yet. The question of what building to put on lot would be dealt with when building permit is applied for.
Mayor Brotherton: Would narrow strip of land adjoining Third Street be used as driveway?
McDermott: Mr. Voparil has not plans, yet. Does not plan to use narrow strip as driveway. Plans to come from College Street.
Mayore Brotherton: Can cul-de-sac handle increased traffic?
Sladek: That is a main artery for the school.
Cox: Almost all kids walk along that street to meet the buses.
Mayor Bortherton: Lot is about 24,000 square feet.
McDermott: I don't know the square footage of the lot, but Mr. Voparil would build within the requirements of R-3.
Mayor Brotherton: When does Mr. Voparil plan to start.
McDermott: Anxious to start as soon as allowable.
Mayor Brothe ton: Would set precedent for other requests.
Motion Rohret second Brown to approve request by Louis Voparil to rezone lot no. 5 of the Sadler Subdivision from R-1 single-family residential to R-3 multi-family residential. Roll call vote: Stevens, nay; Brown, aye; Spivey, nay; Rohret, aye; Cox, nay. Motion denied.
McDermott: Issue is not finished.
Mayor Brotherton: Request comes at a time when we're just becoming familiar with government. Would like to provide comprehensive plans.
McDermott: Mr. Voparil will volunteer to allow you that chance.
Motion Stevens second Brown to amend agenda to move standing committee reports to present time for consideration. Carried unanimously.
Council took short recess at 9:05 p.m.
Engineer Kammerer reported that the FHA has raised interest rates and does not have any grant money available. Engineer estimated that water rates could raise about $6.00 per month per unit if only a new well was drilled. Listed priorities: 1) new well 2) tower 3) plant or main work. If a new subdivision was annexed, city water system could not accommodate it.
