The Tiffin City Council met in regular session on Wednesday, September 8, 1982 at the Tiffin Methodist Church. Mayor Brotherton called the meeting to order at 7:30 p.m. Councilmembers present were Cox, Brown, Spivey, Rohret and Stevens. Also present were Mary Hoefer, Judy Aspelmeier, Barbara Murray, Mike Kammerer, Julia Lyons and several members of her government class. Jerry Cox spoke during community forum concerning cable television. It was decided that the clerk will send a survey with next month's water bills in order to determine citizen interest in cable television. Cox will get figures from Bill Vorbrick of Suttons and Mr. Vorbrick will attend next meeting if interest warrants it. Motion Spivey second Stevens to approve agenda. Carried unanimously. Motion Brown second Cox to approve minutes of special meeting August 11, 1982. Carried unanimously. Motion Stevens second Brown to approve minutes of regular meeting August 11, 1982. Carried unanimously. Attorney Hoefer reported that under Ordinance No. 62, the City should comply with the request by the owners of Tiffin Apartments and bill each tenant directly for services. Clerk was instructed to send separate utility bills to tenants of Tiffin Apartments as requested by Jerry Wear and Greg Downes. Bill will be sent to owner anytime clerk is not notified of current occupants. Owner will be notified anytime tenants are late with payment. If City has problems with this arrangement the ordinance could be amended. Attorney also stated that any apartment or other multi-family complex which has separate water meters should be billing the tenants separately if the owners requests it in writing. At present time the only other apartment complex with separate meters is owned by Louis Voparil. Clerk was instructed to notify Mr. Voparil of this option. Attorney Hoefer presented two options in dealing with the trailer parked on railroad property. The City could file an injunction which would require a longer court procedure, or the City could charge with a misdemeanor. Iowa Railroad could pay the $100.00 fine and leave the trailer there. The thirty day notice expires on September 19, 1982. Attorney reported that Iowa Railroad had responded with a letter which claims that the City is attempting the regulate interstate commerce by enforcing the zoning ordinance against Iowa Railroad Co. Attorney will check this in detail. Motion Spivey second Rohret to instruct Attorney Hoefer to proceed with a misdemeanor charge against Iowa Railroad Co. for violation of Zoning Ordinance by parking trailer in R-1 zone on railroad property if trailer is not removed by September 19, 1982. Roll call vote: Cox, aye; Brown, aye; Spivey, aye; Rohret, aye; Stevens, aye. Carried unanimously. Mayor Brotherton reported that the city did not receive or qualify for grant money from HUD for sewer plant flooding problems. The estimated cost of seeding and berm is $2,000.00. Kammerer will contact the INRC again, and get a closer estimate of cost. Brown will get estimate from Bill Grace for more dike work and dredging.
