Cox: What would stop a truck dock if we went A-2? At one time the railroad wanted a truck dock.
Sladek: Don't create a zone that would allow for two lots. This would stop Bream from selling part of the property, if he buys it, to someone else. Don't know length of Bream's lease. The railroad could move him out of it wanted to use the building or property.
Cox: Railroad wants to sell land and is willing to sell to Bream first.
Sladek: Could go with zoning and make it restrictive enough - more like lumber yards. Call it C-2, not A-2. I don't think it is an agricultural business. He would put up a building in town if someone asked him to. Take some things out of C-1 and put them into C-2. You shouldn't lose much that way. You have a non-conforming use which was grandfathered in because it was there before zoning. I would doubt that the building would be vacant for very long.
Potter: Nothing else could be done without the approval of the Board of Adjustment.
Sladek: Zone C-1 need a 60 x 100 foot lot size, but it is unlimited as to number of buildings on lot. Could zone only a small area so he has only enough room to build in. C-2 could limit the type of business. Bream's business is more like a lumber yard. It's not a warehouse and it's not a place of fabrication. It is somewhere in between. Does it have any other uses besides storage of materials?
Potter: He assembles augers, I think.
Sladek: But he assembles all buildings on site.
Bechtoldt: Is all the rest of it R-1?
Potter: Yes, but people have been all over that area and it looks to me like to railroad is planning to do something there.
Sladek: This is why a new classification should be developed that is very narrow. If you allow an M-1 zone then adjoining pieces would want M-1 also.
Barb: If you rezone part of it and leave the rest of it R-1 it should be compatible with the R-1 zone which adjoins it.
Sladek: Only zone enough for his buildings and draw the line on square footage which would allow only one lot.
Spivey: That looks good to me.
Sladek: It would be zoned very different from anything else around it.
