Morgan: We shouldn't overlook this.
Ted Spivey: What can be done about it?
Attorney: The Council has the discretion in degree of enforcement of any ordinance, at any time. Could file an injunction in district court.
Potter: How about sending a letter to Ken Spivey stating he is in violation of ordinance and giving 30 or 60 days to remove?
Ted Spivey: There's no other alternative. We can't violate our own ordinance.
Morgan: Do it for one and we'd have to do it again.
Ted Spivey: The Council has caused others not to have three buildings on one lot.
Clerk: When I took the minutes of the Board of Adjustment meeting, it was my understanding that the Board did not want to grant a variance to permit placing three buildings on one lot, more specifically, three trailers on one lot.
Flansburg: It's a questions of hookups. If it's moved back and just sits there, it makes no difference.
Clerk: At the Board of Adjustment meeting I didn't see the distinction made about hookups. I could have misinterpreted their intention.
Tim Spivey: I'm asking for permit for one dwelling on one lot. The other problem should be addressed to my folks.
Morgan: Before you didn't want to get rid of it. Now you don't care?
Tim Spivey: In the letter of the law, the small trailer belongs to my folks. I was just trying to represent them before. I have no idea what they'll do with it now. It's on their land now.
Morgan: Have the lot lines been redrawn at the court house?
Tim Spivey: That would have been premature, but I don't anticipate any problems with it.
Ted Spivey: I have no objections to putting your home on your lot, but the Council is violating its ordinance if the small trailer is allowed to sit where it is now. Should set a date to have it moved out and do like the attorney says.
Tim Spivey: It's two different questions now.
Morgan: Put it in writing and give them time to move it out. Get legal work done before issuing building permit.
Tim Spivey: I also need a permit to move in the manufactured home.
Motion Morgan second Spivey to approve Tim Spivey's request for building permit on lot at 105 College Street (right next to locker plant) for a 24' x 60' manufactured home with a 10' x 20' annex, with the stipulation that the lot be at least 60' x 120' and be done in accordance with the Board of Adjustment variance granted on October 15, 1984. Roll call vote: Spivey, aye; Morgan, aye; Cox, aye; Kobold, aye. Carried unanimously. Stevens absent.
Motion Kobold second Morgan to grant Tim Spivey's request for permit to move 24' x 60' manufactured home to lot at 105 College Street is application is in order. Carried unanimously.
Potter placed issue of three structures on lot at 103 College Street under Policy and Administration committee reports because Council felt it was in the City's best interest to deal with problem at this time.
