stated that there are not too many other Associations with which to pool. A lot of the members do not want to give up this way of governing because they want some say in their fire protection. The Association might have to raise the millage rate. Potter instructed council members to contact him with proposed nominations for building inspector. Potter will contact possible candidates. Attorney outlined possibilities concerning property on which water tower is located. 1) The city could buy the parcel of property inside the fence which is not covered by its current deed and get a warranty deed for it. This would be the most expensive option. 2) The City could get a quit claim deed. This is less secure because the title is not thoroughly researched and no abstract is drawn up. 3) There is a potential for adverse possession. The fence has been over the property line for more than 10 years and there have not been an previous boundary disputes. Williams stated that he has not taken possession of ground, yet. The school still owns the property. The school is drawing up a warranty deed for him. He suggested that the school give a quit claim deed and he could have his surveyors pin it off. Hart stated that the 3 feet missing is probably due to another surveyor establishing the point from a different line than MMM Consultants are now using. Williams stated that it should all be decided between the city and the school before he signs the agreement with the school. Motion Morgan second Stoner to instruct Attorney Greenleaf to contact the Clear Creek Community School and resolve the boundary line situation at the water tower with a quit claim deed, if possible, and to get approximately four (4) feet outside of the present fence line. Carried unanimously. Motion Spivey second Morgan to approve request by Dave Stoner for building permit for a 10 by 12 foot deck at 141 W. SEcond Street. Carried unanimously. Mayor will arrange Clean-Up Day with firemen. Hart reported on options for Brown Street. 1) Seal coating would cost about $4,000.00. 2) Bill Grace and Bob Smelser would grade ditches along the three block stretch of 1160 feet and provide 5 loads of gravel for $800.00. They will use larger rock, but dust problem would not be completely solved. Larger rock would slow down speed of traffic. 3) A special assessment for residents along Brown Street could be used for improvements. 4) Entry from highway could be closed off to cut down on traffic. Potter suggested putting a dead end sign at the highway entrance of Brown Street, but was not in favor of a barricade. Stoner reported that he and Herring could build sprayer which could be used for dust control. Hart stated that the chemical sprayed would be washed away after 3 or 4 rains and need to be sprayed again, but that proper drainage is needed whatever option is chosen. Motion Stratton second Stoner to contract Bob Smelser to dig ditches along 1160 ft. of Brown Street and provide 5 loads of roack at a cost of $800.00. Carried unanimously. Potter reported that complaints have been received about careless driving before and after school. Potter will talk with high school principal about problem.
