Potter: We don't currently have an ordinance requiring bonding for contractors digging in town, but it'd be a good idea if we had one. The attorney will work on it. Soivey: What about Kirk Madden's? Clerk: No payment has been received. Potter: You did digging a Kirk Madden's. Both Bob Herring and I called you and told you there was a problem there. You didn't fix it so the town had to hire Bob Smelser and pay him $357.00 to fix it. The sewage was running into the street and we had several complaints. Council felt that you should reimburse someone. Council could only go to property owner for reimbursement. Rugger: The stub I connected into was supposedly the stub to the sewer, per your maintenance man. I measured. Everything was done properly there. Potter: You were 18 to 20 inches off and hooked into a field tile. Rugger: Where was the sewer line? Potter: 18 to 20 inches from there. Rugger: I presumed the city man would have known. Soivey: I disagree. If someone is working with the sewer, he should be able to tell. Rugger: $357.00 is more than I charged Madden for the whole project. Someone is getting fat. Soivey: The town was obliged to get it fixed. You were contacted several times. Rugger: There was frost. Soivey: That can be dug through. Rugger: Not with my equipment. I only have a backhoe. I had to get equipment lined up. Soivey: Should be responsible for your own work. Rugger: I called Glenn and told him the sewer settled. Who is responsible? Soivey: Everything wasn't put in right. Rugger: I wasn't there. I don't see $360.00 for 2 feet. I'll reimburse you for it. Stratton: We had to send letter to Madden because he's the homeowner. Attorney read letter to Kirk Madden dated May 3, 1988. Clerk reported that no further action had been taken.
