Greenleaf: Neither C-1 nor M-1 describes in particular what you wish to do with the building the town bought. This leaves some options open. I would suggest that you consider waiting to see what happens with the bank and then do the whole thing at once. There's no problem with a zoning violation against yourself. Maybe your own zoning ordinances don't apply to the city. The options are 1) Amend the descriptions now and include city owned storage building, or 2) Wait for bank to come forward with request and then rezone everything to maintain control and consistency. The bank may have a buyer in another month. This would give the city more control over what goes on there. Motion Spivey second Stratton to table the rezoning issue for the new city property until Iowa State Bank makes a rezoning request for the remainder of the property. Carried unanimously. Attorney reported that there are no specific procedures for the sale of the old building. It could be sold by best bid or public notice. Hart reported that L.L. Pelling street repair project cost was $15,234.79. Attorney reported that First Trust and Savings Bank of Oxford requested that the business name on the cable franchise documents be changed and brought into conformity with the legal name. AN ORDINANCE AMENDING ORDINANCE NO. 1988-150 REGARDING THE PROPER PARTY AWARDED THE CABLE TELEVISION FRANCHISE was introduced by Eggers. Clerk read ordinance. Second by Morgan. Roll call vote: Eggers, aye; Morgan, aye; Spivey, aye; Stoner, aye; Stratton aye. Carried unanimously. Motion by Stratton second by Eggers to waive the rule or law requiring three readings of this ordinance on three different dates. Roll call vote: Eggers, aye; Morgan, aye; Spivey, aye; Stoner, aye; Stratton. Carried unanimously. Motion Stoner second Stratton to place ordinance upon final reading and adopt. Roll call vote: Eggers, aye; Morgan, aye; Spivey, aye; Stoner, aye; Stratton aye. Carried unanimously. Mayor Potter declared ordinance No. 1988-155 duly passed and adopted. A RESOLUTION FOR THE AMENDMENT OF RESOLUTION NO. 1988-7 REGARDING PROPER PARTY AWARDED THE CABLE TELEVISION FRANCHISE was introduced by Morgan and seconded by Stratton. Clerk read resolution. Roll call vote: Eggers, aye; Morgan, aye; Spivey, aye; Stoner, aye; Stratton aye. Carried unanimously. Mayor Potter declared Resolution No. 1988-10 duly passed and adopted. Greenleaf reported that the First Trust and Savings Bank of Oxford has asked for an assignment of the franchise so they can have a lien on everything with ordinance No. 150 provides that no assignments can be made without council approval. Motion Eggers second Stratton to approve the request for a contingent assignment on the cable television franchise of Richard Rugger d/b/a/ Rugger Communications by the First Trust and Savings Bank of Oxford, Iowa for the purpose of financing the cost of installation of cable television to the City of Tiffin. Carried unanimously. Council instructed clerk to notify bank.
