Mayor Potter called meeting to order at 7:00 p.m. Members present were Eggers, Morgan, Spivey, Stoner and Stratton. Also present were Mike Hart, Stephen Greenleaf, Todd Kimm, Mike Hessel and Paul Slaymaker.
Mike Hessel, manager for Iowa Electric Light and Power Company, addressed the council during community forum.
Paul Slaymaker: If you had a choice of a small child walking on the street or on the sidewalk, where would you want him to walk?
Potter: On the sidewalk.
Spivey: There's only one answer to that question.
Stoner: There's only one answer if you have the choice. There's not a choice here.
Spivey: The council must do what the majority wants with respect to the minority.
Slaymaker: Put me on the agenda for next month.
Council consensus to instruct attorney to write to Robert Thompson and ask him to trim hedge at Lark which blocks the view onto the highway and to ask him not to allow delivery trucks to block Grant Street.
Motion Morgan second Eggers to approve the agenda. Carried unanimously.
Motion Stoner second Stratton to appprove minutes of September 14, 1988 and October 2, 1988. Carried unanimously.
Stratton: Dr. Steele was in the kitchen today and I reported to him that the council was thinking about making Third Street one way. He said he'd get an injunction and stop the city and take us to court. He said it would do more damage to take the buses through the parking lot than to allow them to go on Third Street.
Greenleaf: I don't think he has grounds for an injunction. I haven't checked the Iowa Code, but the city does have an unquestionable right to designate certain streets as one way. I don't know on what grounds he could get an injunction. He'd have to show some legal right that the district is being denied or is being placed in jeopardy. It doesn't appear that he could do that.
Potter: It's up to us to try to get the kids to the school as safely as possible and the council is responding to the citizens who were here last night.
A RESOLUTION THAT THIRD STREET IN TIFFIN BETWEEN COLLEGE STREET AND THE BOUNDARY OF CLEAR CREEK HIGH SCHOOL BE DESIGNATED AS A ONE-WAY STREET ALLOWING TRAFFIC ONLY GOING WEST was introduced by Eggers and seconded by Stoner. Clerk read resolution. Roll call vote: Eggers, aye; Morgan, aye; Spivey, aye; Stoner, aye; Stratton aye. Mayor declared Resolution No. 1988-9 passed and adopted.
