Clerk: I've searched the city records and have not found an easement through the property. Hart: Farmers Home gave the loan on the original water system and put the gate to the south. This would indicate that there was some sort of agreement or easement with the school. Maybe there was an abstracting error. FmHA has strict regulations and would not have allowed this to pass by. The tower could not have been land locked. Williams: You could come from the back and make a new gate. I won't grant an easement. I couldn't sell it if I wanted to make lots. The town could use it in an emergency. Hart: I'll search the court house further. Spivey: We have an easement from the north for the pipe. hart: It's for the construction and servicing of the main only. I can't imagine FmHA funding the project without arrangements for access. Attorney: That's right. Hart: It wouldn't be the first abstract error. I'll check with the FmHA office. Although, 750 feet is a long way to go. Spivey: Would there be a problem in coming from the north? Hart: If Williams sells lots, the city could require access at that time. Potter: We'll research this for another month. Williams: There's a gate north of Herdiska's. Spiovey: Maybe the city could get access from Bill Rogers now or buy a strip of land. Spivey reported that he received complaints about abandoned vehicles. Potter will ask Sheriff's Dept. to look into it and attorney will write letter. Council consensus to hold Holiday Open House on Sunday, December 11 from 1:00-3:00 p.m. at the fire station with the usual arrangement of city providing candy for the children. Hart reported that the sewer lagoon is full of sludge which needs to be pumped out. It has been accumulating for 20 years. Dr. McDonald reported problem to city last month. Hart checked two contractors who remove sludge. Their bids were between $25,000.00 to $44,000.00 to do the whole thing. The city could get by with removing a portion each year. Hawkeye Pumping, Inc. would remove 50 loads per year for $2200.00 per year. He'd start at the center pipes and follow pipes to the creek. The carryover flow is polluting the creek. The plant is overloaded during heavy rains and sludge pits are never used because rain washes it all into the lagoon. Plant was designed wrong. We're still in compliance with the State permit but we can't let this go. Swisher is using this contractor now. Bob would monitor his work to be sure the sludge is being hauled away and not just fluid. The sludge would be incorporated into the land around the plant. The State allows 10,000 gallons per acre or two dry tons per acre. Hart reported that he has the permit from the Johnson County Health Dept. and the county will fund 1/2 of cost up to $200.00 to plug the abandoned well at 310 summerhays Street but he did not contact Don Reynolds because of a death in the family. The city needs to get two bids and measure the depth of the well. Potter reported that the City will take care of the well and Hart should contact Spivey when he gets the bids.
