Mayor Potter called the meeting to order at 7:00 p.m. Members present were Eggers, Morgan, Stratton, Stoner and Spivey. Also present were Mike Hart, Stephen Greenleaf, Bob Herring, Mike Ryan, Jerry Vani, Gergg Geerdes, and Dick Ockereach.
Morgan reported during the community forum that a citizen wanted to replace some broken cement and had been told by various councilmembers that a building permit was needed.
Clerk said the same person contacted her and asked about building a wooden deck, not repairing broken cement. Attorney Greenleaf said he believes the current building code makes it necessary to obtain a permit if a person is replacing a structure, but not if they are repairing part of it.
Morgan also asked about the proposed shelter by the sewer plant. Spivey stated that he would get it done as soon as possible.
Motion Spivey second Stratton to approve agenda. Carried unanimously.
Motion Morgan second Eggers to approve minutes of April 12, 1989. Carried unanimously.
Greenleaf reported that alley between Grant and College streets would have to be sold because it is illegal for a city to give away property. He also reported that a problem exists in that part of the television cable system installed by Rugger runs through the alley, although not the entire length of the alley. The city could either allow Rugger to buy the alley or allow him an easement through it. The third possibility would be to allow Rugger to dig up the cable and put it somewhere else. Greenleaf stated that an was done on the alley and real estate agent Brandstatter recommends that the logical buyers of the alley would be the adjacent property owners.
Spivey: What if we go back to square one and forget?
Greenleaf: That's a possibility. But from what I understood from our last meeting, if anyone wants to use the alley as opposed to the way it has been, it might cause a problem.
Potter: I don't want to maintain it.
Greenleaf: Our research found that parts of the alley were vacated back in 1875, so city may not own all of it. I understand it's been a long time since the city has done anything with it.
Hart: Which property owner did it revert back to?
Greenleaf: Someone who is long gone.
Hart: Was it divided equally at that time?
