Attorney Greenleaf noted to the council that the oral request had been received by the Planning and Zoning in a 2 to 1 vote, which would mean that the request had not been accepted in oral request, and/or that the Planning and Zoning had not recommended approval of the request to city council. If the Planning and Zoning has not recommended approval of the request for rezoning from Johnston and Stevens then it would require a supermajority of four favorable votes for this rezoning request to be approved by the city council. Attorney Greenleaf has drawn up an amending ordinance to provide for change in the official zoning map for the City of Tiffin to provide for this zone request from Johnston and Stevens. Clerk asked if the Public Hearing should precede action on the ordinance. Attorney Greenleaf indicated that this was not the ordinary order, however, the Public Hearing could be held during the next regular meeting of March 13, 2002 when the Ordinance will also be read for the second time. Copies of the request will be sent to all council and planning and zoning members. Councilmember Dils reminded the applicant that at the time of the Planning and Zoning meeting, a plan for the entire area had been requested, and that placement of a four-plex in this section of the city did not seem optimal unless there was a plan for the entire area. No plan has yet been received by the city. On the 13th day of February, 2002, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Gericke introduced Ordinance No. 2002-251, and Ordinance entitled, AMENDING THE OFFICIAL ZONING MAP OF THE MUNICIPAL CODE OF TIFFIN, IOWA, FOR CERTAIN PROPERTY KNOWN AS 230 MAIN STREET, 300 MAIN STREET AND 310 MAIN STREET, TIFFIN, JOHNSON COUNTY, IOWA, and moved that it be given its first reading. The motion was seconded by Councilperson Shaffer. Aye: Bartels, Gericke, Shaffer, Walls and Dils. Nays: None. Five members of the council being present and having voted "Aye", Mayor Glenn R. Potter declared the motion carried, and Ordinance No 2002-251 was read the first time and discussed and placed on record. Motion Walls, second Bartels to set date Wednesday, March 13, 2002 for Public Hearing at 6:30 p.m. at the Tiffin Fire Station for a rezoning request from R-1 (single family) to R-2.5 (multiple family) from Joe Johnston and Amanda Potterfield for 230 Main Street (Lot #5 Tantlinger's First Addition and 2 lots of 300 Main Street (Lot #4 Tantlinger's First Addition) and 310 Main Street. Application from Joe Johnston and Amanda Potterfield requires list of all property owners within 200 feet. Application from Greg S Stevens is incomplete. Ayes: Gericke, Walls, Dils Gericke and Shaffer. Motion carried.
