Attorney Greenleaf informed the Clerk that records in regard to claim of Third Street that had been subpoenaed on the 4th day of May for a May 6th date would now be set back to a new date of May 10, 2002. Greenleaf said compliance date changes can be negotiated by attorneys of the case informally, and need not be in writing. Additionally, Mr. Johnston, the issuing party can release the subpoenaed party. As Attorney Greenleaf released the city clerk from appearance prior to the delivery of the subpoenae, the clerk did make appearance on May 10, 2002. Documents should be provided to city attorney, Mr. Greenleaf. Greenleaf said that new and additional evidence my be submitted at a later date if they were located prior to case. Attorney Greenleaf said that Mr. Johnston could also be subpoenaed for the case. Attorney Greenleaf thought the subpoena was authentic as it had an official signature, even if it did not have a seal. Dils asked if Attorney Greenleaf would determine if the subpoena was authentic. The Johnson County Clerk of District Court had advised that the city attorney be notified of the lack of seal on the subpoena. Attorney Greenleaf advised that the subpoenaed be answered regardless of its authenticity, as Mr. Johnston could always send an actual subpoena at a later date if he should desire to do so.
