Part of this rezoning request for duplex zoning would include an agreement from Mr. Stevens to drop litigation efforts against the city for any portion of the public street called Second Street and used as Second Street in this same area. Mr. Joseph Johnston has initiated litigation against the City to claim Second Street. Mr. Stevens said that he thought Mr. Johnston desired to be a thorn in the side of the city and believed that Attorney Johnston thought that seeking litigation that would close the street might help the city make up their minds about matters. Mr. Stevens explained to the council that he would drop all litigation problems for any portion of Second Street now used by the public, as would Mr. Johnston if this plan for a duplex could be approved.
Discussion on whether this could be completed at this meeting. The city ordinances require that a zoning request for R2 include opportunity for Public Hearing and public comment and input. Mayor Potter expressed disgust with time constraints. Bartels said his goal was to repair the street problem and provide an improvement here and asked what anyone cared about the law. Greenleaf said he would study the matter to see how this could be moved along as soon as possible. Greenleaf felt that the arrangement discussed could be put to writing.
Sidewalks in the community were discussed. Broken sidewalk on North Potter Street near Johnson plex. Mary Ann Herdlska has sidewalk that was broken by trucks getting to water tower. Southslope caused sidewalk and landscape damage between Blish and Walls property on Roberts Ferry near box works. Ted Spivey has driveway damage done by South Slope. Vehicle driving on sidewalk has caused damage at 341 Main. Orange dump truck remains parked on west end of Sewell Street. Planning and Zoning has recommended that the city council take action to improve the sidewalk ordinance to make sidewalk improvements easier to effect.
