I-2 - Resolution 2025-008 - 28E Agreement for Roundabout at FGR and Jasper Avenue

CHAPTER 28E AGREEMENT BETWEEN THE CITY OF NORTH LIBERTY, THE CITY OF TIFFIN, THE CITY OF CORALVILLE, AND JOHNSON COUNTY REGARDING CONSTRUCTION OF A ROUNDABOUT AT JASPER AVENUE AND FOREVERGREEN ROAD This Agreement is entered into in between Johnson County, Iowa ("County"), City of North Liberty, Iowa, a municipal corporation ("North Liberty"), City of Tiffin, Iowa, a municipal corporation ("Tiffin"), and the City of Coralville, Iowa, a municipal corporation ("Coralville"). North Liberty, Tiffin, and Coralville are collectively referred to as “the Cities” hereinafter. WHEREAS, the corporate boundary lines of County, North Liberty, Tiffin, and Coralville meet south of the intersection of Forevergreen Road and Jasper Avenue; WHEREAS, Cities have entered into a Settlement Agreement which provides, in part, for the construction of a roundabout at the intersection of Forevergreen Road and Jasper Avenue ("Project"); WHEREAS, such Project will be located within the jurisdictions of County, North Liberty, Tiffin, and Coralville; WHEREAS, North Liberty has agreed to be the lead agency in constructing the Project; and WHEREAS, it is now necessary for County, North Liberty, Tiffin, and Coralville to enter into a 28E Agreement to outline the obligations and responsibilities of each party as it pertains to the construction, payment and maintenance of the Project. NOW, THEREFORE, THE CITIES AND COUNTY AGREE AS FOLLOWS: 1. Purpose The purpose of this 28E Agreement is to set forth the duties and obligations of Cities and County in connection with the construction, payment and maintenance of the Project. 2. Consideration It is hereby expressly acknowledged by Cities and County that construction and maintenance of the Project by North Liberty and the payment in part by Tiffin and the issuance of permits and general cooperation by all parties in accordance with the terms and conditions set forth in this Agreement constitutes mutual and sufficient consideration to enter into this Agreement.
