G-1, H-1 - Ordinance 2023-503 - Rezoning 3287 Ireland Ave NW - Tiffin West - R-1E to C-2B and M-1

are all zoned M-1, and two of the five lots are conveyed by Landowner to a third party other than Developer prior to August 22, 2033, only those two lots may be returned to R-1E zoning classification by the City. City recognizes that Landowner and Developer do not have the ability to dictate any zoning classification; but Landowner and Developer agree not to contest or protest efforts to re-zone the property as described herein and shall cooperate with City to the extent reasonable in order to carry out this Agreement. The parties acknowledge that this Rezoning Agreement shall be deemed to be a covenant running with the Property and with the title to this Property, and shall remain in full force and effect as a covenant with title to the Property, unless or until released of record by the City of Tiffin, Iowa. The parties further acknowledge that this Agreement shall inure to the benefit of and bind all successors, representatives, and assigns of the parties. The parties agree that this Rezoning Agreement shall be incorporated by reference into the ordinance rezoning the Property, and this agreement shall be recorded in the Johnson County Recorder’s Office.
