G-1, H-1 - Ordinance 2023-503 - Rezoning 3287 Ireland Ave NW - Tiffin West - R-1E to C-2B and M-1

REZONING AGREEMENT This Agreement is entered into between Nevada Cahow, as Trustee under the Will of Bessie S. Hagist, Deceased, and her successors in said Trust (Landowner) and Honey Lane Development, LLC (Developer) and the City of Tiffin, Iowa (City). It is the intent of both parties that this Rezoning Agreement will be incorporated into the record of the City procedures to amend the zoning classification for property owned by Landowner, and recorded with said Ordinance Rezoning Property. Landowner and Developer have requested certain real property located at 3287 Ireland Ave NW Tiffin, Iowa, and legally described as SE ¼ NW ¼ in Section 33, Township 80 N, Range 7W, as more particularly described in the attached ordinance, containing 26.44 acres, and subject to easements and restrictions of record, in Tiffin, Iowa (the "Property") to be rezoned from its existing R1-E classification to an M-1 classification so that the Landowner and Developer may proceed to utilize the Property. It is anticipated the Property will eventually consist of several lots. If, prior to August 22, 2033, the entire Property is conveyed by Landowner to anyone other than Developer, Landowner and Developer consent to the City returning the Property to its original zoning classification of R1-E (or a different classification if the City deems appropriate). If, prior to August 22, 2033, any Lot that is a portion of the Property is conveyed by Landowner to anyone other than Developer, Landowner and Developer consent to the City returning that Lot to its original zoning classification of R1-E (or a different classification if the City deems appropriate). For clarification purposes, it is the intent of this Agreement that if the Property is subdivided into, as an example, five separate lots that
