DocuSignEnvelopeID:D51B811C-005B-4E17-AB47-6DFB9C126183 RESOLUTIONNO.2017-087 RESOLUTIONAPPROVINGTHEESCROWAGREEMENTANDSECOND FOR WOODFIELDRIDGEPART6 Whereas,theDeveloper hasrequested theCityenter intoanescrow agreement prior to completion ofthealltheimprovements inthesubdivision andrequired bythe subdivision, and; Whereas, agreement addressing thetwolots abutting Ironwood Lane, and; Whereas,thefinalplatisfound toco Ordinances and Subdivision Agreement withtheexceptions noted intheescrow agreement, attached; Now,thereforebeitresolvedbytheCityCouncil oftheCityofTiffin, Iowa thatthe Mayor andCityAdministrator/Clerk arehereby authorized toexecute thedocuments necessary toapprove thefinalplat assubmitted andasapproved bytheCityEngineer andCityAttorney, but, asacondition ofitsapproval, theapproval ofthefinalplatare contingent onthefollowing: 1)Woodfield Ridge Part6executing theattached escrow agreement; 2)Execution bytheSubdivider andother necessary parties ofallother documents required bytheSubdivision Ordinance orSubdivision Agreement, including easement agreements. Thefinal platmaynotberecorded andnolotsmaybe transferred untilthese contingencies have been completed. th Onthe19 dayofSeptember, 2017, ataregular meeting oftheTiffin CityCouncil, Tiffin, Iowa, Councilperson Ryan introduced RESOLUTIONNO.2017-087,A RESOLUTIONAPPROVINGTHEESCOWAGREEMENTANDSECOND FORWOODFIELDRIDGEPART6 andmade amotion forapproval. Motion seconded byCouncilperson Kahler. Ayes: Bartels, Havens, Ryan, Kahler. Nays: None. Absent: Upton Whereupon fourCouncil members were present andvoted approval andMayor Berner declared thattheRESOLUTIONNO.2017-087,ARESOLUTIONAPPROVINGTHE ESCOWAGREEMENT AGREEMENTFORWOODFIELDRIDGEPART6tobeadopted andsignified his approval ofthesame byaffixing hissignature thereto. th Passed bytheCityCouncil onthe19 dayofSeptember, 2017.
