This paragraph relates tothedetention basin inOutlot C,shown intheSWcorner ofthepreliminary plat andlocated inWoodfield Ridge Part 1.Inorder toprovide water quality andquantity, aportion ofthe existing 42inch storm sewer will be removed andreplaced byDeveloper tolower the water surface ofthepond. A second 42inch outlet pipe forthepond willbeinstalled byDeveloper asan emergency outlet. Aconcrete control structure willbeinstalled byDeveloper to provide thewater quality volume. Alloftheabove described work issubject to inspections andapproval bytheCity Engineer, andshallbeacceptable tothe City. Additionally, theparties agree that Biohaven Floating islands may beinstalled by theCity, ifrequested bytheCityandapproved bytheState inconnection with the SRF-sponsored project. The sizeanduseoftheBiohaven Floating islands will be determined bytheCity Engineer. IV. NoOther Modification. Except asexpressly modified bythisAmendment, and except asmaybenecessary toincorporate thechanges effected bythis Amendment, the Agreement, andeachofthecovenants, agreements, andtimerestrictions contained therein, areratified andconfirmed inevery respect andwillremain asafullyeffective document enforceable inaccordance withits terms. The City andtheDeveloper have caused thisAgreement tobesigned, intheir names and ontheir behalf bytheir duly authorized officers, allasofthedayanddate written above.
