DocuSignEnvelopeID:09F9FFBE-2F5A-4B42-8352-2AD786380BAF RESOLUTIONNO.2017-067 ARESOLUTIONAPPROVINGFINALPLATOFCENTRALPARKCONDOMINIUMS ASAPLANNEDDEVELOPMENTOVERLAYDISTRICT Whereas,Hochstedler Building & Development, asSubdivider hasfiled withtheCity Clerk oftheCityofTiffin, Iowa, anapplication forapproval ofthefinalplatofCentral Park Condominiums, asaPlanned Development Overlay District, Tiffin, Johnson County, Iowa, which islegally described asfollows: Seeattached Exhibit thatisincorporated intothisagreement AndWhereas,TheCityEngineer hasdone afinalexamination ofthefinalplat, and; Whereas,theCity andtheSubdivider, theirsuccessors andassigns, have reduced to terms aSubdivision Agreement thatwillberecorded withJohnson County, and; Whereas,theinfrastructure improvements aresubject tothree-year maintenance bonds perDesign Standards asapproved byCityCouncil, suchmaintenance bonds tobe posted when theimprovements have been completed andaccepted byCity, and; Whereas Ordinances andSubdivision Agreement. Now,thereforebeitresolvedbytheCityCouncil oftheCityofTiffin, Iowathat the Mayor andCityAdministrator/Clerk arehereby authorized toexecute thedocuments necessary toapprove thefinalplat assubmitted andasapproved bytheCityEngineer andCityAttorney, but, asacondition ofitsapproval, theapproval ofthefinal platis contingent onthefollowing: Execution bytheSubdivider andother necessary parties of allother documents required bytheSubdivision Ordinance orSubdivision Agreement, including easement agreements; thefinalplat maynotberecorded and nolots maybe transferred untilthese contingencies have been completed. Therecording oftheplat andthisresolution willindicate these contingencies have beencompleted. BeItFurtherResolved thattheSubdivider ofthisproperty willbear thecosttorecord thisresolution and subsequent legal documents withtheOffice oftheJohnson County Recorder. th Onthe15 dayofAugust, 2017, ataregular meeting oftheTiffin CityCouncil, Tiffin, Iowa, Councilperson Havens introduced RESOLUTIONNO.2017-067RESOLUTION APPROVINGTHEFINALPLATOFCENTRALPARKCONDOMINIUMSASA PLANNEDDEVELOPMENTOVERLYDISTRICT, TIFFIN, JOHNSON COUNTY, IOWA andmade amotion forapproval.
