Effective immediately, theOwner oritssuccessors shall noterect orconstruct any
structure o
express written consent oftheCity.
Upon therecording ofaresolution bytheCity accepting thededication andconveyance,
inwhole orinpart, ofthe Right ofWayDedication, theproperty accepted by
the City without payment ofanycompensation, andanyfences, trees,
structures, orother improvements located within theproperty may beremoved bytheCity
without compensation orreplacement. The City shall notberesponsible for anydamages caused
bytheremoval ofany fences, trees, structures orother improvements.
Upon therecording ofaresolution bytheCity which disclaims anyinterest inandtoany
part ofthe ture Right ofWay Dedication, theterms ofthisConditional
Dedication andConveyance shall nolonger apply astothat property.
Nothing contained inthisinstrument shall bedeemed toconstitute anagreement bythe
City toaccept thededication ofsaid property. Any decision regarding acceptance ofthis
dedication shallbewithin the solediscretion oftheCityCouncil oftheCity ofTiffin, Iowa.
