Such inspections shall not relieve orrelease theDeveloper from itsresponsibility toconstruct said Escrow Items in accordance with the approved plans andspecifications. Further, said inspections shall notcreate aduty orwarranty onthepart oftheCity that theconstruction ofsaid Escrow Items isin compliance with said plans andspecifications. 3. Upon satisfaction oftheterms asoutlined inParagraph 2 theCityshall promptly distribute theEscrow Amount toDeveloper. 4. After installation andacceptance bytheCity, Developer shall have noobligation formaintenance ormanagement ofsaid Escrow Items whatsoever, except asprovided inthe 5. The Developer agrees tocomplete theEscrow Items onorbefore November 1, 2017 6. Intheevent theEscrow Items isnotcompleted bytheConstruction Deadline, the City may, butshall notberequired to,utilize theEscrow Amount tocomplete theEscrow Items. 7. Intheevent theEscrow Amount isinsufficient topayfortheEscrow Items, the Developer shall payfortheexcess costs incurred. 8. TheCity hereby grants totheDeveloper atemporary construction easement in, over and across the forthe purpose ofconstructing theEscrow Items ascontemplated herein. 9. Except asspecifically provided above, nothing inthis Agreement shall be construed toimpose arequirement ontheCity toinstall thepublic improvements herein, nor installation oftheabove-described improvement. 10. Intheevent ofadispute between Developer and City astothesatisfactory completion oftheEscrow Items, theCity may deposit theEscrow Amount with theClerk of Court for theJohnson County District Court. Either party maythereafter make application tothe Court fordistribution ofsuch funds. 11. This Agreement shall notbeconsidered alienonany lotsinthe Subdivision.
