DocuSignEnvelopeID:C0AB2B92-03E4-4151-9CCA-2F3EDA600EB9 RESOLUTIONNO.2017-064 RESOLUTIONTOAPPROVETHEESCROWAGREEMENTFOR TIFFINHEIGHTSEAST Whereas,theDeveloper hasrequested theCityenter intoanescrow agreement prior to completion ofthealltheimprovements inthesubdivision andrequired bythe subdivision, and; Whereas, Ordinances and Subdivision Agreement withtheexceptions noted intheescrow agreement, attached, and; Now,thereforebeitresolvedbytheCityCouncil oftheCityofTiffin, Iowa thatthe Mayor andCityAdministrator/Clerk arehereby authorized toexecute thedocuments necessary toapprove thefinalplat assubmitted andasapproved bytheCityEngineer andCityAttorney, but, asacondition ofitsapproval, theapproval ofthefinalplatare contingent onthefollowing: 1)Tiffin Heights East executing theattached escrow agreement; 2)Execution bytheSubdivider andother necessary parties ofallother documents required bytheSubdivision Ordinance orSubdivision Agreement, including easement agreements. Thefinal platmaynotberecorded andnolotsmaybe transferred untilthese contingencies have been completed. th Onthe15 dayofAugust, 2017, ataregular meeting oftheTiffin CityCouncil, Tiffin, Iowa, Councilperson Kahler introduced RESOLUTIONNO.2017-064,ARESOLUTION TOAPPROVETHEESCOWAGREEMENTFORTIFFINHEIGHTSEASTandmade a motion forapproval. Motion seconded byCouncilperson Ryan. Ayes: Upton, Kahler, Ryan, Havens, Bartels Nays: None. Absent: None. Whereupon fiveCouncil members were present andvoted approval andMayor Berner declared thattheRESOLUTIONNO.2017-064,ARESOLUTIONTOAPPROVETHE ESCOWAGREEMENTFORTIFFINHEIGHTSEASTtobeadopted andsignified his approval ofthesame byaffixing hissignature thereto. th Passed bytheCityCouncil onthe15 dayofAugust, 2017.
