SECTION 16. SUCCESSORS AND ASSIGNS This Agreement shall be a covenant running with the land and inure to the benefit of and be binding upon the parties, their successors and assigns. SECTION 17. OVER-SIZING The City will pay Developer for the difference in the extra cost of materials to provide within the subdivision: (a) water main, (b) sanitary sewer main and (c) storm sewers with capacity greater than required to serve the subdivision. The City will pay for the cost of materials directly attributable to the over-sizing of the infrastructure identified above, as approved by the City engineer. Payment will be made within sixty days after acceptance of the respective public improvements.
