4. TERMINATION. This Agreement may be terminated by either party by giving advance written notice of termination no later than May 1 prior to the start of the next contract year on July 1, with termination effective on July 1 of that year. In addition, either party may terminate this Agreement immediately upon written notice to the other party if the other party commits a material breach of this Agreement and such breach remains uncured thirty (30) days after written notice of the breach is given to the breaching party. This Agreement may also be terminated upon mutual agreement of the parties. Upon any termination of this Agreement, each party shall have sole possession and use of its respective property. 5. RESPONSIBILITIES OF THE PARTIES. A. DISTRICT. The District will employ a part-time school crossing guard(s). The District will recruit, hire, train, assign, supervise, evaluate, discipline, and terminate the school crossing guard(s) in accordance with its regular employment procedures. The District will have the right and authority to make the final determination for all employment aspects of the school crossing guard(s). The school crossing guard(s) shall not be deemed an employee(s) of the City for any purpose; however, the City may provide input into the selection and retention of the school crossing guard(s). The District will assign school crossing guard(s) to designated street crossing locations at designated times when school is in session during the regular school year. There will be at least a morning shift before school, and an afternoon shift after school. The school crossing guard(s) will serve to temporarily interrupt and stop the traffic flow in order to facilitate the pedestrian safety of school children through a crosswalk, and, after the cross walk is cleared of pedestrians, restart the traffic flow. The school crossing guards(s) locations and times of service for this Agreement are as follows: <table> <tr> <th>School</th> <th>Crossing Location</th> <th>Morning Time</th> <th>Afternoon Time</th> </tr> <tr> <td>CCA MS</td> <td>Ireland/HWY 6</td> <td>7:30-8:25</td> <td>3:20-4:00</td> </tr> </table> B. CITY. The City will make payment to the District for the school crossing guard(s) as provided in this Agreement. The City will also be responsible to stripe (e.g., mark, paint) or otherwise designate (e.g., roll-out stop signs, signage) the areas designated as street crossing locations. The City will also consult with the District to provide guidance regarding pedestrian safety and ensure compliance with applicable laws. 6. COST SHARING. The District will pay the school crossing guard(s) all wages and other benefits to which they are entitled as employees of the District. The City agrees to equally share the costs associated with employing the school crossing guard(s). The City will pay the District fifty percent (50%) of all costs incurred by the District in connection with employment of the school crossing guard(s), including, but not limited to, wages, federal and state taxes, IPERS benefits, health and other insurance benefits, worker compensation insurance and benefits, unemployment insurance and benefits, and protective clothing, safety equipment, and training.
