SUBDIVIDER'S AGREEMENT TIPPIN EAST SUBDIVISION OXFORD, IOWA THIS AGREEMENT made by and between Clarence Sewell and James Stetzel, hereinafter called "Subdivider", and the City of Tiffin, Iowa, a municipal corporation hereinafter called the "City". WITNESSETH: Section 1. Incorporation of Subdivider's Agreement. In consideration of certain transfers of property and monetary consideration as set forth herein, the Subdivider's hereby agree that the Subdivider's Agreement of their predecessor in interest, Glenn A. Swenka, for Tiffin East Subdivision was duly executed by and between Glenn A. Swenka, as Subdivider, and Ronnie Swenka, regarding marital rights only in, and the City of Tiffin, on the 29th day of October 1993, and is recorded in Book 1648, Page 211 through Page 238, on November 4, 1993, in the office of the Johnson County Recorder are hereby incorporated into this Agreement as set forth in full herein. Specific references made to Section 13 of the Subdivider's Agreement providing that it shall be binding upon the parties hereto as well as their successors and/or assigns shall be construed as a covenant running with the various lots within the subdivision. Section 2. Conveyance of Property by Sewell and Stetzel. Subdivider shall convey to the City certain lands shown as Lots 7 and 8 of the Final Plat of Tiffin East Subdivision. The conveyance shall be for fee title. Section 3. Conveyance of Property by the City of Tiffin, Sewell, and Stetzel. City shall convey a portion of Outlot A of the Final Plat of Tiffin East Subdivision as set forth with more particularity as follows and as shown in the Final Plat of the Resubdivision of Lots 13 through 22, and a portion of Outlot A - Tiffin East Subdivision, Tiffin, Iowa: Beginning at the southwest corner of Lot 13, of Tiffin East, in accordance with the plat thereof recorded in Plat Book 34, at Page 6, of the Records of the Johnson County Recorder's Office; thence N87 degrees 30' 55"E, along the north line of Outlot "A", of said Tiffin East, 475.27 feet, to the northeast corner thereof; thence S00, degrees 17'41"E, along the east line of said,
