CITYOFTIFFINORDINANCENO.2017-399 ANORDINANCE AMENDING THE MUNICIPAL CODE OFTIFFIN, IOWA, SECTION 99.10(1)OFCHAPTER 99, PAYMENT OFBILLS – SEWER ADJUSTMENT BEITENACTED bytheCityCouncil oftheCityofTiffin, Iowa: Section I.Purpose: Thepurpose ofthisordinance istoamend Section 99.10(1)ofChapter 99oftheMunicipal CodeofTiffin, Iowa, toamend payment of billsexception section andchange ittoasewer adjustment section. Section II. Amendment. Section 99.10(1)ofChapter 99ishereby amended as follows: CHAPTER 99 SEWER USER CHARGE SYSTEM 99.10(1) SEWER ADJUSTMENT. Upon application toandatthediscretion oftheTiffin City Council, eachcustomer oraddress within theCorporate Limits of theCityofTiffin may beallowed aone-timeadjustment onthesewer billatthat address ormeter withanadjustment capof $250.00. Atwelve-month average billing amount willbeestablished fromthetwelve immediate previous billing cycles. The customer willpaynolessthantheaverage ofthoseprevious twelve months. Taxwill bepaidontheoriginal fullbilling amount, regardless oftheamount ofadjustment. If anadjustment ismadetothecustomer’ssewer billunder thisordinance thentheone- timewater adjustment mustalsobeusedatthesametime. Section III. Repealer. Allordinances orpartsofordinances inconflict withthe provisions ofthisOrdinance arehereby repealed. Section IV. Severability Clause. Ifanysection, provision orpartofthis ordinance shallbeadjudged invalid orunconstitutional, suchadjudication shallnot affect thevalidity oftheordinance asawhole oranysection, provision orpartthereof notadjudged invalid orunconstitutional. Section V. When Effective. Thisordinance shallbeineffect afteritsfinal passage, approval, andposting asprovided bylaw.
