Ordinance Adopted: 5/13/98 Any person orpersons, asowner oragent, who shall dispose oforoffer for sale any lot orlots within the area of jurisdiction of this ordinance, until the plat thereof has been approved by the City Council, and recorded as required by law, shall forfeit and pay amount set by City Council currently $100) to the City for each lot or part of lot sold, disposed of or offered for sale, the violatorwill alsobesubject toasimple misdemeanor ormunicipal infraction foreachlot sold inviolation ofthis provision. Nothing contained herein shall in any way limit the City's right to any other remedies available to the City for the enforcement of thisordinance. These remedies include, but are not limited to, the city'sability to institute an action for injunction, mandamus orother appropriate action or proceeding toprevent any pending disposal oroffer ofsale, ortoprevent any further disposal oroffer to sale in violation of this ordinance. Amended by 2012-319 1. 07BUILDING PERMIT TOBEDENIED Nobuilding permit shall beissued for construction on any lot, parcel, or tract, where asubdivision is required by the ordinance, unless and until a final plat of such subdivision has been approved and recorded inaccordance with this ordinance, and until the improvements required by this ordinance have been accepted by the City or other provision have been made in writing with the City regarding thecompletion of improvements. Asacondition of the issuance ofbuilding permits, sidewalks will be required to be constructed in every subdivision within the city limits within one year after the construction of a building on said premises or within fiveyears following the approval of the final plat for the subdivision if construction has occurred in more than fifty percent of the lots within the subdivision. Before anybuilding isinhabited all sidewalks must beinstalled. Inallcases, sidewalks mustbeinstalled onalllotswithin a subdivision within five (5)years ofthefinal plat approval.
