Ii; C1A 1983- 118; AN ORDINANCE AMENDING THE ZONING ORDINANCE NO. 1979- 83 OF THE MUNICIPAL CODE OF TIFF IN, IOWA BY CHANGING THE USE REGULATION OF CERTAIN PROPERTY FROM R- 1 SINGLE- FAMILY RESIDENTIAL TOR M- 1 INDUSTRIAL BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF TIFFIN IOWA: SECTION I. Purpose. The purpose of this Ordinance is to amend the zoning map of the Zoning Ordinance 1979- 83 of the No. Municipal Code Tiffin, of Iowa by changing the use classification of the reat estate described in Section II, from R- 1 Single- s44 Family Residential to M- 1 Industrial SECTION II. Amendment. The tract of land hereinafter described shall be follows: zoned as from R- 1 Single- Family to M- 1 Industrial Commencing at concrete nail found at. South Quarter corner of Section 28, Twp 80 N, R 7 W of the 5th PM; thence NO'' bearing) along bO' 00" E ( an assumed the West line of the Southeast Quarter of said Section- 28, 630. 45 ft; Thence N 87° 40' 24-" E, 873. 31 feet, to a point which is 50. feet normally distant Northwesterly of the centerline of the Main trackage of the CRI&P RR Co. , and which Point is ' the Point of Beginning; Thence N2° 19' 36" W, 100. 00 feet, to a point on the Southeasterly line of Railroad St.; Thence N87 40' 24" E, 200. 00 feet, along said Southeasterly line; Thence S2° 19' 36" E, 100. 00 feet, to a point which is 50. 00 feet normally distant Northwesterly of said Railroad centerline; ' Thence S87 'k0' 24" W, 200. 00 feet to Point of Beginning. Said. tract of land contains 0. 46 acres, more or less, and is subject to easements and restrictions of record. SECTION III. Authorization. The mayor or other appointee of the City Council is hereby directed to change the zoning map on the City of Tiffin, Iowa which was duly recorded in Book 19, page 53, Recorder of Johnson County, to conform to this amendment upon the final passage, approval and publication as provided by law. SECTION IV. Certification. The City Clerk is hereby authorized and directed to" certify a copy of this ordinance to the County Recorder of Johnson County, , Iowa,. upon final passage, approval and publication as provided by law. SECTION V. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are repealed. SECTION VI. Saving Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjucation shall not affect the validity of this ordinance as a whole, or any section, provision or part thereof not adjudged invalid or unconsti- tutional. b 9
